Terms and conditions of sale for contracts concluded at a distance

I. In the regulations we use terms:

b. You - the buyer; any natural person, legal entity or organizational unit without a legal entity

private purchases - purchases made by a consumer or an individual,

who is engaged in business activity, provided that these purchases do not

have a professional character for this person, digital content - products in digital form - both those

digital - both those transmitted electronically (e.g., product keys) and

saved on a carrier (e.g., CD, DVD).

c. our store - the online store at www.amii.pl.

d. private purchases - purchases made by a consumer or an individual who

carries out business activities, provided that the purchases are not of a professional nature for that person

6.As a seller, we are obliged to provide you with items free from defects. All products in our store are brand new, free from physical and legal defects and legally introduced into the Polish market. However, we may also sell products that have been used for a short time or used as a display - we mark such products appropriately and describe them as outlet.

9. if you register an account you can additionally check your history of operations on our store - for example, order history.

10. you can register an account on the AMTII registration page. During registration accept our terms and conditions. Confirmation of registration will be sent to your e-mail address.

11.At any time you can delete your account. To do this:

IV. Sale of products - how you can buy products in our store

14.We sell products from our store on the website www.amtii.pl and accept orders by phone and e-mail.

15.We do not sell wholesale products in our store.

16.You can place orders in our store through the website www.amtii.pl, email and telephone. In our store you can do it in two ways:

    • through your account,
    • without setting up an account - if you accept the terms and conditions each time.

17. To shop in our store:

a. Read the product information.

b. Add products to your cart (if available).

c Select the method of delivery.

d. Select a payment method.

e. Enter the recipient's data.

f. Check the summary of your order.

g. Place your order using the "Buy and pay" button.

18. We will send confirmation of the conclusion of the contract to the E-mail address you provided in your order.

19. Your order is valid for 5 calendar days from the day we prepare it. If you do not pick up the product within this time, do not pay for it or we cannot contact you - we will cancel it.

V. Delivery - how we deliver your purchases

20. we deliver the products only within the territory of Poland.

21. we deliver the products in the way you indicate when ordering:

a. By courier

b. To parcel machines

22. you can check the cost of delivery on www.amtii.pl/dostawa.

23.Your order is delivered the next business day if the order was placed by 2:00 p.m. If the delivery time of the item is longer, the approximate delivery time will be written next to the product offer in our online store.

24 When you pick up the parcel, you confirm its receipt - with your signature or through the parcel system. If you are shopping privately, from that moment you are the owner of the product and are responsible for its damage or loss.

25 If you notice that the shipment or its contents are damaged or incomplete (even if the packaging is not damaged) - report the complaint to the carrier. This will facilitate the complaint procedure.

a. With courier delivery:

- report the complaint directly to the carrier - preferably if you

write a protocol of the condition of the shipment with the courier.

You can file a complaint with the carrier within 7 days of

receipt of the shipment; or

- contact us (preferably within 24 hours of receipt of the shipment) - via the

b. For parcel delivery:

- Show the damage in front of the camera;

- Place the damaged, unopened parcel in the same box of the

26 If you buy several products, we can divide them into smaller shipments. In this case, the delivery cost we gave you in the order summary will not change.

27. if we cannot fulfill your order, we may instead offer you other products of the same quality, purpose and price (substitute service). You can choose to accept these products, or you can cancel the contract. [Legal basis: Article 27 of the Law of May 30, 2014 on Consumer Rights].

VI.Payment - how you can pay for your purchases

28.The prices of all products in our store are given in Polish zloty. We provide gross prices, that is, prices that include VAT. The price of the product does not include the cost of shipping.

29.You can pay for your purchases in several ways - depending on which method of delivery you choose. If we deliver your order to you:

a. By courier - you can pay:

- By wire transfer (prepayment)

- Electronically via dotpay (prepayment)

- Cash (on delivery)

- By credit card or blik (upon receipt at selected couriers)

b. To a parcel machine - you can pay:

- by bank transfer (prepayment)

- electronically via dotpay (prepayment)

- by credit card (on delivery, at selected parcel machines)

30 We charge a transaction processing fee if you choose to pay:

a. Electronically via dotpay.

b. By payment card at a parcel machine.

The fee depends on the shipping costs and the total gross value of the products you order. We will give you the exact amount of the fee in the order summary before you place the order. If you choose to pay by card at the parcel machine, we will charge an additional fee for the transaction - regardless of the cost of delivery.

31 We issue and send invoices in electronic form. We guarantee the authenticity of their origin and the integrity of their content.

32.We will deliver each electronic invoice to the email address you indicate to us, or that you provide during registration. If you change your email address - notify us in writing or by email. If you fail to do so, we will treat messages that we send to your existing e-mail address as properly delivered.

33) We are not responsible for incorrect invoice data if you indicate such data during registration or when placing an order.

34. each time you place an order, you can opt out of the electronic invoice. Then add a comment next to your order requesting a paper invoice.

35. if you withdraw from the contract or when we successfully consider your complaint, in which you have chosen to return the funds such a refund will be made by the method in which the payment was made.

VII. Right of withdrawal - how you can cancel the purchase

36 If you are shopping privately and conclude a contract at a distance - that is, you buy products in our store outside the showroom - you can withdraw from the contract concluded at a distance and return your purchases. The rules we describe in this chapter apply to you only in such a case.

37.You can report the return - that is, withdraw from the contract - within 14 days from when you pick up the product (you, or a person you designate other than the carrier). You do not have to give a reason.

38.You can send a statement that you are withdrawing from the contract:

38 You cannot return the product and withdraw from the contract if:

  • we have performed the service in full with your consent and we have informed you before the performance that after we have performed it, you will lose the right to withdraw from the contract;
  • you buy a product that we have prepared according to your individual specifications or for your individual needs, for example, a computer with customized assembly or a smartphone with engraving;
  • you are buying sound or visual recordings or computer programs from us, which we will deliver to you in a sealed package and you will open it;
  • we delivered the product to you in a sealed package for hygiene and health reasons, and you open it;
  • you have auctioned the product at a public auction;you purchase a product that, after delivery due to its function, becomes inseparable from other things e.g. used printer ink.

39.If you use the product you return - you are responsible for the reduction in its value. You can use the product only to check its features and functions.

40. the product you return, send it back to us as soon as possible - up to 14 days from when you report the return to us. When you buy a product in a set with another product, you can only return the whole set. When you withdraw from a sales contract, you also withdraw from contracts ancillary to that contract.

41.If you withdraw from the contract without stating a reason (within 14 days), you bear the cost of directly returning (returning) the product to us.

42. if, when placing an order, you choose a method of delivery of products other than the cheapest, ordinary, offered in our store - we will reimburse you only the cost of this cheapest method of delivery.

VIII. Complaints - how you can make them

43. if you buy products from us, you have the right to make a complaint.

44. you can make a complaint about the product under warranty to us in any form. We recommend that you submit it via emajl amtii@sklep.pl This will allow us to process your claim faster.

a. complaint processing time:

  • 14 days from receipt of the customer's statement and goods - in the case of warranty claims excluding withdrawal from the sales contract, or 30 days from receipt of the customer's statement and goods - in the case of withdrawal from the sales contract in connection with the implementation of warranty claims,
  • 14 working days from receipt of the customer's statement and goods - in the case of claims under the warranty, with the understanding that if it is necessary to send the defective goods or their parts to specialized services, the period of processing a claim may be extended to 28 working days.

45 If you make a claim via e-mail on our website, wait until you receive a message from us with instructions. When we accept your complaint, we will send you an email message. In it, we will provide your claim number (RMA number) and instructions on what to do next.

46 Your claim number (RMA) is valid for 7 days. If you send the product after this period, we may have trouble identifying it.

47. you can:

48. when we consider your complaint, we can send you a document with the result of service expertise.

49. you can collect the claimed product in the form in which you delivered it to us.

50 When we accept the product from you at our service, we will issue you a service receipt. This is the only document with which you can pick up the product at our showroom without checking your details.

51 You can pick up the product within 30 days after we notify you that we have processed the complaint. If you fail to do so, we will send you a summons and give you another 14 days to pick up the product. After this time, we will be able to charge you a fee for each month of equipment storage. This fee is 5% of the current rate for 1m2 of storage space in Czestochowa.

52 Most of the products we offer in our store come with a manufacturer's, importer's or our warranty. You will find the warranty terms and conditions in the product's warranty card. You have the right to take advantage of the product warranty, even if you do not receive a warranty card at the time of purchase. This provision does not exclude, limit or suspend your rights that arise from consumer rights and warranty provisions.

53 If you are a businessman, we mutually agree that we exclude our warranty liability for physical and legal defects in the product. First of all, we agree with you that, as a seller, we will also not be liable for hidden defects in the product. This condition does not apply to private purchases (item 1 d).

54 If you are shopping privately, you have the right to use out-of-court means of complaint handling and redress, and you may do so:

IX. Privacy and personal data - how we process and take care of your data

55 We process your personal data in accordance with applicable law and our privacy policy. You can find the privacy policy in the appendix to these terms and conditions.

56. we process your personal data when:

  • you shop at our store. We process your data when we handle the transactions and services you use while shopping;
  • you use other services that are available on our site;
  • you consent to marketing activities. to present you with content tailored to your needs;
  • we have a legitimate interest to process your data (e.g. when you make a claim to us).

57 You give us your data voluntarily. Please note that if you do not provide them to us, we will not be able to offer you our products and provide you with services.

58. the administrator of your personal data is us, i.e. AMTII with its registered office in Dominów 63-012 at: Biskupice23. You will find our detailed data in the first paragraph of these regulations.

59.You always have the right to access your personal data - within the limits of the law. You can correct them, delete them, limit their processing, object to the processing of your data. You also have the right to have your data transferred and to file a complaint with a supervisory authority. You have the right to withdraw your consent at any time, which does not affect the legality of the processing of your data prior to its withdrawal.

At this address you will find our information clause and detailed information about the processing of your personal data, including information about your rights.

X. Changes to the regulations - how we can change the rules

61 If we change these rules, we will make them available in our store at least 7 days before the new rules take effect. The exception is if:

  • an immediate change is forced upon us by a legal or regulatory obligation;
  • we want to protect you from fraud, malware, spam, data breaches or other cyber security threats.

62 If you have an account with us, we will inform you of the change in the terms and conditions the next time you log in. We will then ask you to accept the changes to the terms and conditions. You will accept the changes to the regulations by clicking in the box of this message. If you do not accept the changes, the system will log you out. In this situation, you can continue shopping in our store without logging in, in accordance with our terms and conditions.

63.Orders that you place before the new regulations come into effect, we will process in accordance with the previous rules.

64. the amendment of the rules does not affect the acquired rights of users who use our store.
